The Illinois Workers Compensation Reform bill that was passed on September 1st was adopted in order to reduce workers compensation costs to Illinois businesses. One part of the bill was the exclusion of work comp benefits when the proximate cause of the injury was due to employee's intoxication or if the employee's level of intoxication was sufficient to constitute a departure from employment.
Initiating a Drug Free Workplace program has MUCH MORE significance now. Even if we only adopt a Post-Accident policy. The typical drug free program includes:
- Post-Offer (pre-employment) Testing
- Probable Suspicion / Reasonable Cause Testing
- Post-Accident Testing
- Random Testing
